These Terms and Conditions (“Terms”) govern the provision of website-building and hosting services by Websites For Free to business clients. By agreeing to have your website published, you agree to these Terms in full.

1. Who we are

Websites For Free is a trading name of Iraida Fernandez Ochoa, operating as a sole trader (empresária em nome individual) based in Portugal. Contact: hello@websitesforfree.eu.

These Terms apply to services provided to businesses commissioning a website for their own trade, business, or profession. They are not intended for individuals purchasing services for personal, non-business use.

2. The service

We build your website at no design or build charge, as agreed with you during your free consultation. The specific pages, features, and content included are those confirmed in your client brief. Anything requested beyond that brief — additional pages, ongoing content changes, advanced features, or work outside the original scope — is treated as an optional extra and will be discussed and agreed with you separately before any additional charge applies.

3. Publishing and your 12-month hosting commitment

When you agree for your website to be published, you are committing to a minimum term of 12 months of hosting with Websites For Free, at the hosting price confirmed to you at the time (currently €24.99/month).

Your website is built and published at no design or build charge to you. In return, you commit to the 12-month hosting term, which is how that build cost is recovered over time. If you cancel before the 12-month minimum term ends, you agree to pay an early termination fee, calculated as follows:

Early termination fee = €150 × (remaining months in your 12-month term ÷ 12)

This fee reflects the unrecovered portion of the cost of building your website — not the hosting fees you would otherwise have paid for the remainder of the term. For example, if you cancel with 8 months remaining in your term, the fee would be €150 × (8 ÷ 12) = €100.

This fee is charged instead of, not in addition to, any remaining monthly hosting payments.

4. Payment

Hosting is billed monthly, in advance. Your first payment is due before your website is published, and each subsequent month’s payment is due on or before the equivalent date each month.

If a payment is missed, we may suspend your website until payment is received, without affecting your ongoing obligation to pay for the remainder of the 12-month term.

5. Domain names

If a domain name needs to be registered or transferred for your website, you are responsible for the cost of securing that domain, paid upfront, separately from your monthly hosting fee. We’ll confirm the exact domain cost with you before registering anything on your behalf.

Unless otherwise agreed in writing, the domain is registered in your name and remains your property, regardless of your hosting arrangement with us.

6. After the initial 12-month term

Once your initial 12-month commitment ends, hosting continues on a rolling monthly basis at the then-current price, until either party cancels with 30 days’ written notice by email.

7. Your content and intellectual property

You confirm that any content, images, logos, or material you provide for your website is either owned by you or that you have the right to use it, and that it doesn’t infringe any third party’s rights. You’re responsible for the accuracy and legality of the content you provide.

Ownership of the website. The website we build for you — its design, code, and underlying template — remains the property of Websites For Free. You do not own the website itself; what you’re paying for is the ongoing right to have it built, hosted, and made available at your domain for as long as your hosting relationship with us continues.

If you would like to own the website outright — for example, to move it to different hosting, or take over the code yourself — this is possible via a separate buy-out arrangement, to be discussed and agreed with us directly. Terms and pricing for a buy-out are not fixed in advance and depend on the specific website and circumstances at the time.

If your hosting relationship ends (whether at the end of the 12-month term, on notice under Section 6, or through early termination under Section 3) without a buy-out having been agreed, the website will be taken offline and you will have no further right to use it.

8. No guaranteed results

Where SEO (search engine optimisation) services are provided, we’ll carry these out using reasonable skill and industry-standard practice. We do not guarantee specific search rankings, traffic levels, or business outcomes, since these depend on factors outside our control, including search engine algorithm changes and market competition.

9. Liability

We aim to keep your website online and functioning reliably, but we don’t guarantee uninterrupted availability, and we’re not liable for losses arising from hosting downtime, third-party service outages, or events outside our reasonable control.

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

10. Cancellation and termination for other reasons

We may suspend or terminate your website and hosting if you breach these Terms, including non-payment, provision of unlawful content, or use of the site for illegal purposes. If your website is terminated for these reasons before the end of your 12-month term, the early termination fee under Section 3 still applies.

11. Changes to these Terms

We may update these Terms from time to time. If we make a material change affecting an active client relationship, we’ll notify you by email before it takes effect.

12. Governing law

These Terms are governed by the laws of Portugal, and any disputes will be subject to the exclusive jurisdiction of the Portuguese courts.
